UNC’s timeframe & 3 reasons why CMFD’s Sgt. Schultz defense isn’t plausible (Day 85)

I assume most of you have heard by now about the UNC comments following the BOG meeting today.  You can watch a report and read about it here also.  This stuff gets covered in real-time during the day on our message boards which is one of the reasons we are always trying to send your attention that way.

The big story is that the folks in Chapel Hill have publicly acknowledged that it could be a year or more before a final NCAA decision comes down the pike.  This is the first realistic timeframe publically admitted to by UNC.  Butch and Baddour have spent the better part of the last two months telling people that the “review” was almost over while other coaches and UNC ‘insiders’ made it a habit of perpetually leaking the same stories to their buddies in the Tar Heel online media – ‘there is nothing to worry about’ and ‘this will be over by next Friday’.

They could not have possibly believed this stuff even as they said it, and I wonder if this bit of finally-admitted reality will put a crimp into Butch’s recruiting pitches.  Also Thorp looked and sounded very down to me compared to the happy face he has been projecting before today.  I am not sure what to read into that.  There are several funny quotes to enjoy, such as (from Thorp):

“Coach Davis knows he has a lot of work to do.”

What does that even mean?  As an example of my previous comments, we already had a thread discussing this on our message boards .

Tonight’s second topic has to do with the current spin out of Chapel Hill — that Butch heard nothing, saw nothing, and knew nothing about the full catalogue of violations going on under his nose.  Given that we will be hearing this for a while, in this entry I will go through some of the reasons why this line of reasoning is ludicrous.

Before I even get started, it is important to realize that Butch’s supposed ignorance does not matter.  This entry does an excellent job detailing the NCAA’s written policy that ignorance is not an excuse for a head coach’s failure to maintain control.  Also, when assessing Butch’s credibility remember that Butch has said that Marvin is being suspended for reasons unrelated to the “review,” and that Marvin is in the process of “working his way back on the team.”  I will let you decide if those are credible statements.

I am not even going to touch on the fact that Butch supposedly had no idea about the day-to-day actions of his Associate Head Coach and Recruiting Coordinator.  Common sense tells you that this is a person the Head Coach would be with/in contact with ALL THE TIME.  But we are to believe that Blake had all sorts of relationships and communications without Butch knowing anything about them whatsoever.  Riiiiiight.  But let’s look at three small specific things a little closer.

#1 – Butch’s “Sgt. Schultz defense” relies on you believing that Butch did not know about Blake’s reputation when Blake was hired at UNC-CH. Butch recently made a huge production of saying that he was sorry he trusted John Blake and acting very surprised that Blake would do the things UNC-CH now is finally admitting Blake did.  You can read the full N & O piece about it here.  But, given that Blake’s reputation was so well known, can we really believe that Butch had no idea what Blake would be up to?  As you can read here, Steve Spurrier made it very clear that Blake’s shady reputation was well-known and well-established in the coaching community.  Certainly Davis, even if he hadn’t known Blake for decades (which he had), would have known of this reputation through coaching circles.  Furthermore, Blake’s reputation was also known by the general public.  Butch’s contention that he did not know Blake’s reputation does not pass the laugh test.

#2 – “Sgt. Butch” would have us believe that he employed the football tutor to help his son AFTER she was let go by the University, yet had no idea there was any problem with the football team. Remember, according to Thorp, she was let go because “there was too much of a friendship between her and the players.”  You can read the full details here with the  pertinent dates — the tutor’s contract with the University was not renewed in the summer of 2009.  Yet she worked for Butch Davis into May of 2010 — and all that time Butch supposedly had no clue there was any problem with her and/or the football team’s academics.  It is not believeable that Butch employed a person in such a position of trust for nearly a year without knowing what happened — particularly when she was let go due to innapropriate tutoring conduct with the football team.  Remember as an aside here that UNC somehow still claims that they “self-reported” the cheating element of this scandal even though they did nothing to investigate or report the tutor (let go by the University in the summer of 2009) until her name came up during NCAA questioning of players about agents in the summer of 2010.  That is some great quote-unquote “self-reporting”!  The next time you get caught doing something you shouldn’t, why not take UNC’s lead and “self-report” your misdeed to whoever just caught you.  See how that works.  For example, if your wife catches you with another woman, go ahead and “self-report” your violation right then and see how that goes.  Leave it to UNC to come up with a rationalization so ridiculous and then try to pass it off as legitimate.  Hilarious!

Anyway, once again something was right under his nose but Butch knew nothing!

#3 – Butch’s “Sgt. Schultz defense” requires us to believe that Kendric Burney  knew more about Marvin Austin’s dealings with agents than did Butch Davis.  Remember that Kendric Burney’s dad explained in this article  that Kendric did not go to the Miami agent party in May because he knew that there would be agents there and this would be improper. (Kendric instead made the “wise” choice to go to Las Vegas with Chris Hawkins, but that is another story).   How in the world is it possible for the Miami agent party to have been known about ahead of time by UNC-CH players such as Kendric, but not be ever known about by Butch, the other coaches, the UNC compliance office, etc, etc.?  Also, if Kendric (and certainly other players) knew about this upcoming improper party, why would they not report it to their Head Coach???  Does this sound like a culture of compliance to you????

    “I know it’s hard for people to understand this,” he [Thorp] said, “but the facts keep changing and we are still working to get to them.

    After they’re done defining what “is” is, the might want to work on the definition of “fact”.

    I think what he really meant was:

    “You people aren’t that smart, you weren’t supposed to find out about all this” he said, “you keep learning more and more and we are still working to get control of it”.

    Factually speaking Butch “never even got out of bed this morning”…to steal another line from Sgt. Shultz…

    If if Butch were to somehow be totally innocent, he’d have to be pegged as the dumbest SOB that ever drug his knuckles in Chapel Hill~~ He would make Gomer Pyle look like a Rhodes Scholar~

    This is pure gold. This cumulative record of what has been said and what gets invalidated later by contradictory statements or uncovered events is priceless.

    It is the mark of a rogue program, marketed as the “model” for all other college athletics programs, finally being exposed, layer by layer.

    Dickie B may profess a “cool” demeanor when he goes before the press, but all of these things put together smack of pure desperation, mistake after sweet mistake.

    And poor Butch is totally unprepared to deal with the media, or the entire situation.

    I would love to see a “Cliff’s Notes” version of this in the local media. But I’m not holding my breath.

    The facts don’t change…what facts that Thorp & Baddour know change.

    This is why they would have done themselves all big favors by keeping their mouths shut in the process and ‘volunteering’ for an independent investigation to get themselves out from the middle of all of this.

    I’ve always felt like these bastards were “untouchable”. Not any more. There’s too much out there for them to skate. There’s no way they get out of this lightly. They’re going to get hit – and hit hard.

    Among the several bad things about this for them:

    this guy coming into the presidency of the NCAA doesn’t sound like the type to mess around. And he will be firmly entrenched in the position by the time they are ready to rule on this.

    This may be the “new sheriff in town” ruling.

    Butch could pull the “aw shucks” routine if this were his first big-time HC job, if this was his first big time college-coaching gig and if he wasn’t familiar w/ big-time athletes and football…or if he was some old warhouse (read Bobby Bowden or Joe Paterno.)

    Butch, of course, is none of these. He spent several years as an assistant, then the head coach at the “U”. He’s spent time in the NFL – as both an assistant and a HC.

    As stated before – Blake’s rep was well-known – both as a dynamite recruiter and as a questionable actor. If you bring this guy in – if you’re really interested in running a clean program – what do you do? You watch him like a hawk…Butch didn’t do that did he?

    So, you’re left w/ the question “why”? There are only 2 possible answers:
    A – This same guy who spent his formative college coaching years at the “U” and w/ the Dallas Cowboys didn’t know that this was how the “game” was played by some.

    B – He knew that Blake was a questionable actor – but in the words of Tony Soprano when describing someone “he’s a good earner” – so you don’t ask questions. You just enjoy the benefits.

    I’d actually be shocked if Butch was directly involved. I think he sent Blake out there on the road to do a job – and dammit, he was doing it.

    I’ll end this by saying that the behavior I witnessed by the Tar Heel football team in the game last year in Raleigh was a disgrace. Was there any evidence whatsoever that Butch was bothered by it?

    So, Butch’s only out is if everything was done in secret, right? (I seem to recall in one of the previous entries that they can be held accountable for being ignorant of the goings-on, but not if it was done secretly) So, it seems that Butch’s plea of shock and awe and not having a clue about what was going on could be a subtle suggestion that the Blake portion, at least, was all being down on the extreme D-L so that there was no way Butch could have known anything. So, that would put it in the “secret” category; not the “ignorance” category.

    For argument’s sake, I’ll go ahead and give credence to Butch’s statement of not knowing because Blake kept it well-hidden. But, here’s where I think Butch still loses out on that front: Blake’s rep was no secret coming in which means that Butch should have kept an extra sharp eye on Blake b/c of his past and since he did not, that moves this from the category of “secret” (no matter how secretive Blake was) to “ignorance” and the responsibility lay completely at Butch’s feet.

    I don’t think anyone is buying what Butch is selling anymore. That whole “ignorance” act is getting old. I bet most UNC supporters are beginning to look at each other with raised eyebrows at this point.

    The bottom line is if you’re the person in charge, ignorance of wrong-doing in your organization will not get you out from under any potential disciplinary action, up to and including termination.

    I’ve been saying that for a while now. If Butch did not know beforehand AND was intent on running a clean program, there would have been AT LEAST ONE PLAYER that would have come to him and said “Uhhh, coach…I hate to tell you this, but….”

    Since that either didn’t happen, or more likely it did and he ignored it….HE WAS IN ON IT!!!! This ain’t brain surgery, folks. People like John Blake don’t just happen to become associate head coach and then….”whoa John, whaddya think yer doin’ there?” Doesn’t happen that way! BMFD knew Blake personally and knew his reputation. More importantly knew WHY Blake had that reputation and that it was well-deserved. He further believed, and was likely reassured, that the media would NOT be a problem at UNC, no one would come poking their nose around. The bitch of it all is that he was RIGHT!!

    What he did not count on was that his own players would be so stupid as to openly and brazenly tweet about their many exploits and kick this whole mess into gear. If it weren’t for that, UNC-CHeat would likely be kicking ass and taking names so far this season, and they’d still be spouting off about doing it the “right way”.

    Facts do NOT change, they comprise what “TRUTH” is. If it’s true then it’s a fact. What may happen is someone portrays something to be a fact when it isn’t true, which makes it not a fact, and it becomes a falsehood. And that my friends is the basis in FACT, all they keep putting out is falsehoods. Shame on the whole bunch for lying. Tell the truth and take your lumps. This is like that string on your sweater, you tug on it expecting it to go away and instead the whole sweater goes away.

    I’ve seen several posts were posters are saying that Butch brought in his own hires to run compliance for football.

    Has this been positively confirmed? If that’s the case – to me, it’s pretty much game, set and match.

    bradleyb – we don’t do we. And it is easily verifiable, but when the paper would rather your program succeed than fail, you don’t turn over every rock you can find looking for scandal. OTOH, when a wolfpack “fan” notifies the N&O about Tracy Smith parking in a handicapped spot….
