A piece from the email:
When the case first arose more than 20 years ago, a federal judge in the District of Columbia ruled on appeal in favor of the Washington Redskins and their trademark registrations.
Why?
As the district court’s ruling made clear in 2003, the evidence ‘is insufficient to conclude that during the relevant time periods the trademark at issue disparaged Native Americans…’ The court continued, ‘The Court concludes that the [Board’s] finding that the marks at issue ‘may disparage’ Native Americans is unsupported by substantial evidence, is logically flawed, and fails to apply the correct legal standard to its own findings of fact.’ Those aren’t my words. That was the court’s conclusion. We are confident that when a district court review’s today’s split decision, it will reach a similar conclusion.In today’s ruling, the Board’s Marc Bergsman agreed, concluding in his dissenting opinion:
It is astounding that the petitioners did not submit any evidence regarding the Native American population during the relevant time frame, nor did they introduce any evidence or argument as to what comprises a substantial composite of that population thereby leaving it to the majority to make petitioner’s case have some semblance of meaning.
The evidence in the current claim is virtually identical to the evidence a federal judge decided was insufficient more than ten years ago. We expect the same ultimate outcome here.”

PackerInRussiaParticipantAs fans it’s easy to focus on the bowls from our perspective only. Notice in her 2 reasons for needing a bowl, she has a completely different perspective. It’s not about fans, but about developing players and getting recruits. You trade out one of the OOC teams this year and put in a big name team, you’re trading a good chance of a win for a sure loss. It would generate short-term buzz (leading up to the game only) to have a big-name team on the schedule. As most have pointed out, this team will be doing everything it can to squeak into a bowl. The player development and recruiting boost will have a longer-term benefit than the big-name/sure-loss game would. You could claim that it doesn’t reward fans to have that kind of schedule, but doing everything you can now with a team that stands a lesser chance of succeeding in order to give yourself the best chance for a good team in the future makes a lot of sense. And if it does give you a better team in the future, that’s better for fans in the end. It’s like the national security vs. personal freedom balance and this is a time when national security side needs more attention (in the analogy; not getting into wider political statements).
PackerInRussiaParticipantI prefer what I call “sentimental optimism.” I have a hope for winning that’s connected to my love for all-things NC State. But, it’s far enough removed from being “pragmatically optimistic” that when they wind up losing, I’m not surprised or disappointed. It helps me be happy and enjoy a game without really caring if/when they lose. I think it also helps to live 5,000 miles away. It’s easy to be philosophical about losing when you don’t have to hear it from co-workers the next day.

Once again, plausible deniability for UNC. Later, they’ll just be able to say, “No, we didn’t lie. No one who signed it actually understood what it said.” Always one step ahead. Geniuses. I hope the tutoring department didn’t have to stay up late crafting one more masterpiece for the boys. Anyone check to see if the signatures were all in the same writing?

Surely that would help him be more satisfied with his academic experience or lack thereof. It’s gonna be hard not to be a McCants fan from now on. I eat this gourmet cupcake in honor of you, Rashad.

PackerInRussiaParticipantOK, I just watched the Anderson Cooper interview. Reminded me a bit of my neighbor when he’s intoxicated. I guess was expecting “mentally incapacitated” to mean more of a non-functioning brain or something like that. So, bad news is he can’t own an NBA team. Good news is he could probably get a light sentence for committing a crime. Well, except for the fact that he’s Donald Sterling.

PackerInRussiaParticipantI’m sure the new logo is fine. I think no matter what, though, it’s just not going to be that impressive because there’s only so much you can do with 3 letters. It’s hard to go, “Wow! I can’t believe they were able to come up with such an awesome representation of 3 letters, 2 of them repeating.” The problem is that everything has to be celebrated and made a big freakin deal of. Just quietly change the logo and let it start being noticed or make a small announcement like it’s not a big deal: “Oh, by the way, we changed the logo.” Then someone might say, “Hey, that’s not too bad.” Once you start offering a grand description, backstory, origin film, whatever, you make a bigger deal than is necessary and turn it into something absurd. Like something you’d expect from a novel about a bureaucratically-controlled, dystopian future or something.

PackerInRussiaParticipantBad news: that’s a Turkish cab. Getting it all the way back to Turkey will be pretty tough. Good news: it’s a Turkish cab. They’ll never look for it in your garage. Worse news: you’d better be careful in the future. If you travel internationally when you’re drunk and don’t even realize it, you could wake up with a really, really expensive hangover some day. Worst news: there’s already a movie about that, so trying to recoup the losses by making a buddy movie involving humorous hijinx is out of the realm of possibilities.
PackerInRussiaParticipantI wonder if Carlos will get traded to a contending team before the playoffs begin. We could get some good prospects that could give us a nice foundation for the future.

PackerInRussiaParticipantGotta love baseball. Of the 3 VT starters, Scheetz by far has the worst ERA, but is 4-1 whereas the other 2 have losing records. Markey’s ERA is almost half of Scheetz’s, but he’s 2-7.

PackerInRussiaParticipantI like the emphasis on getting kids to graduate since most will not be playing in the pros and will need a career to fall back on (other than English-Swahili interpreter). But, I don’t get the penalty for transfers either. It doesn’t seem too fair, but maybe there’s a good reason (with the NCAA I doubt it, though). Also, what about a player who leaves early and goes pro. He’s not graduated, but he’s been prepared for his future career and is now doing it. Doesn’t seem so bad either. Maybe you should get bonus points for that?
